Deferred Disposition

What is it?

Deferred Disposition is a form of probation that, when completed successfully, may result in the dismissal of your case. The probation period may be up to 180 days. You must complete the term, including the payment of fees, and satisfy any requirements of the court. If you successfully complete the probation, there is not a final conviction and the complaint may not be used against you for any purpose.

You may be considered for Deferred Disposition, without a formal court appearance, if:

• You were charged with a traffic-related or parking offense
• You plead Guilty or No Contest to the offense
• You do NOT hold a Commercial Driver’s License (CDL)
• For speeding, you were speeding less than 25 miles per hour over the speed limit
• For speeding, your speed was not over 95 miles per hour
• The violation was not in a construction or maintenance zone when workers are present
• You are not currently on Deferred Disposition Probation
• You have not been on Deferred Disposition Probation within the last 12 months

How do I request Deferred Disposition?

1.    Appear. Make a request and enter a plea within 20 working days from the date of your citation:

• Online. Start your application.
• By Mail. Download the Request for Deferred Disposition Form (PDF), complete the form and follow the instructions.
• In-person. Visit the Frisco Municipal Court during regular business hours at 8450 Moore Street, Frisco, TX 75034. 

2.    Pay. If approved, you are required to pay the deferred fee. In most cases the amount is the standard fine and state court costs plus $50.00, without exceeding the maximum amount allowed by law. Refer to the Fine Schedule for the base amount.

3.    Juvenile? If you are under 17 years old or an adult defendant charged with non-traffic violations, you must appear before a judge to request deferred disposition. I want to request a court date.

Mandatory Conditions for Young Drivers

If you are younger than  25 years of age at the time of the alleged offense and charged with a moving violation, you will be required to complete a Driving Safety Course as a condition of probation. Additionally, if you held a Provisional Driver’s License you will also be required to complete a Road Test with the Department of Public Safety.
