1. When did the new ordinance become effective?: July 28, 2016

2. What is the right of way?: Right of way (ROW) is that portion of the street and parkway which is owned by an agency or association such as the City, State, County or HOA. In most residential areas it extends approximately 10 feet beyond the curb.

3. Does this apply to the franchise utility companies and their contractors and sub contractors?: Yes

4. Does this apply to builders and their contractors?: Yes

5. Does this affect construction of new subdivisions?: Yes, it affects the areas along streets open to the public. Please note the new streets under construction do not become right of way until accepted by the City.

6. Can I be grandfathered?: No. New stormwater requirements take effect July 28, 2016.

7. The State requires inlet protection. Right?: No. In the past, the SWP3 designer may have included inlet protection on the SWP3. The new ordinance will require SWP3 designers to use other BMPs.

8. How can pollutants be reduced without inlet protection?: Contain pollutants on the job site behind the curb. Clean any pollutants entering the street by the end of the day.

9. Can inlet protection cause buildings to be flooded?: Yes and it has.

10. Are there types of inlet protection that can be used?: Yes. There are inlet protection devices available that can be installed inside of the inlet box. Inlet protection must not obstruct the flow of water into the inlet. Z-frame inlet protection restricts the flow.

11. Where should the placard be on the job site?: In the location most likely seen by those who work on the site.

12. Can I print my own placard?: Yes, print the placard which is at the stormwater page.

13. Can materials be stored on the street?: No.

14. Can materials be stored in the right of way behind the curb?: Yes, but controls must be used to prevent material from being washed or blown into the street.

15. Who is responsible if a subcontractor makes a mess?: The site operator is responsible if applicable. If not it is the property owner.

16. Who do I contact for more information?: Contact the stormwater inspector for your site. If you do not have one click on stormwater contacts.
